Summary/Abstract: In the recent years, Bosnia and Herzegovina, like the rest of the world, has been investing intensively in the sector of renewable energy sources and in projects for the construction of power plants with renewable energy sources. In order for the construction of renewable energy power plants to proceed smoothly, it is necessary to have stable legislation and legal frameworks within which all the steps of the process are clearly defined. Unfortunately, when it comes to the legal regulation of the energy sector of Bosnia and Herzegovina, it still does not allow the process of building renewable energy power plants to proceed smoothly, and leaves enough room for various criminal malfeasance, and increases the risk of committing criminal acts, non-finalization of started projects and large financial losses for the state. The main role in the Bosnian energy market is played by private investors, that is, private companies that invest in renewable energy sources and the state that provides subsidies or land on which renewable energy power plants will be built. Over the years, various criminal malfeasances that occurred during the construction of renewable energy projects have been noticed, however, the opinion of private investors and beneficiaries of state subsidies has never been examined in the available literature. It is extremely important to know the attitude of private companies that invest in the sector of renewable energy sources when it comes to the current state of the energy sector in Bosnia and Herzegovina, the current legislation, the complete process of building renewable energy power plants, and whether there is a real danger of crime occurring in the construction process of the renewable energy power plant. In order to examine the attitude of private companies, a questionnaire (survey) was created in which participated private companies that invest in the sector of renewable energy sources and those companies that already had one or more finalized projects of renewable energy power plant construction in the period between years 2013. and 2023. on the territory of Bosnia and Herzegovina. It is important to point out that those companies that already had one or more finalized projects participated in the questionnaire, because this means that they had enough contact with state procedures and insight into all the processes and legal regulations necessary for the construction of the power plant and that they can objectively answer the questionnaire. As the legislation in the Federation of Bosnia and Herzegovina differs from the legislation in the Republic of Srpska, two separate surveys were made in accordance with the relevant legislation. The results of a survey conducted in which private companies involved in investing in the sector of renewable energy sources took part present the dissatisfaction of private investors when it comes to the transparency of the process and the presence of crime in the sector of renewable energy sources. The results of the questionnaire indicate that the procedures are not transparent enough, and the laws are not sufficiently adapted to the needs of the market. It is necessary to change the legal regulations, and then find appropriate methods of prevention and timely detection of potential criminal activities in the process of building renewable energy power plants, both in the short term and in the long term.
