Summary/Abstract: Although seemingly in an early stage, neurotechnologies are capturing the attention of international actors. The protection of fundamental human rights should be rethought or at least readjusted to the new challenges. Even though the issue addressed in this article may seem purely theoretical, it is crucial as neuroscience stands at the border between brain activity and what constitutes an individual’s identity. The brain is not and cannot be considered as just another organ of the body. A person is much more than their neural activity, although this activity is necessary for a person to be the kind of individual they are. Therefore, the issue arises of developing an adequate legal framework for their use in tandem with new technologies.
