Summary/Abstract: Starting from the revival of the debates on migration within the European Union, which in fact gave the party “Law and Justice” (PiS) a pretext to organize a referendum, the author analyzes in this article the workings of the referendum in Poland as enshrined in the Constitution. By observing what this mechanism implies for Polish representative democracy and for citizen participation, the author identifies a series of shortcomings that constitute an obstacle to the effective exercise of the right to participate.
