Summary/Abstract: In order to overcome obstacles to the free movement of capital in the European Union and greater integration of capital markets, a Proposal for a Directive of the European Parliament and of the Council on the alignment of certain aspects of insolvency law has been drafted. The proposal focuses on three key dimensions of insolvency law: the recovery of assets from the insolvent estate, procedural efficiency, and the predictable and fair distribution of recovered value among creditors.
