Legal Protection of Software in the Light of the Law on Copyright in Bosnia and Herzegovina

Summary/Abstract: In this paper, we try to examine to what extent the software on the Bosnian market is protected by applying the Law on Copyright and Related Rights in Bosnia and Herzegovina. We also point out the problems and results of such copyright protection, and offer suggestions for achieving greater efficiency in preventing piracy software and copyright infringement on software (computer programs). This paper aims to explore the level of protection of software in Bosnia and Herzegovina, as well as to determine whether only the Act Authors Copyright and Related Rights in Bosnia and Herzegovina is sufficient to achieve the necessary protection and whether it is necessary to take other steps to protection of software, as an important resource of economic development both worldwide and in our country. Scientific content analysis, historical and normative methods are used during the research. The Law on Copyrights, and Related Rights in Bosnia and Herzegovina is used as a source of analysis. The results suggest that in Bosnia and Herzegovina exist conditions for high grade protection of software and that the Law on Copyright and other Related Rights in Bosnia and Herzegovina has followed the modern world standards.On the basis of the research, a conclusion can be made that in Bosnia and Herzegovina is a qualitative basis for the protection of software, but that the executive and judicial powers should be given a greater role in the implementation of enacted law and penalize those who are engaged in software piracy.
