Summary/Abstract: In the interpretation of Article 1.386 paragraph 1 of the Civil Code, in conjunction with Article 1386 paragraph 1 of the Civil Code, only when reparation in kind is no longer possible, or the victim does not wish to use this form, the damage will be repaired by paying its equivalent in cash equivalent, aiming at the perfect equivalence between damage and compensation.
