Summary/Abstract: The distinction between family tombs and hereditary graves evoked by the juristconsult Gaius (120-180 AD) finds another echo in Ulpian’s works (≈170-223/224 AD2). If the text of Gaius remains quite clear, Ulpian’s position is difficult to interpret and could provide a double definition of hereditary tomb when this model seems to be the only remaining due to its insertion regarding succession law. According to imperial constitutions, this orientation seems to be confirmed in epiclassic law. Moreover, on a religious point of view, it is the principle of sacra perpetuity which took precedence over the ‘purity’ of family cult.
