Summary/Abstract: Classical roman law of tombs is composed by miscellaneous rules closely interlinked with roman ideology of paganism. Death belongs to the nature of the religion field itself, as a part of an understanding system of the world. In this hybrid context, the jurist Gaius (120-180 AD) establishes a distinction between family tombs and hereditary graves. The first ones are intended to accommodate familia members whereas the second ones are destined to the founder’s heirs. This paper focuses on the exegesis of D.11.7.5 and tries to demonstrate that this distinction refers to old law categories.
