Summary/Abstract: The institution of legal protection of human rights was established to guarantee equal human rights’ protection to all people. Despite the development of universal and regional standards, which determine safeguards guaranteed to children, they form a vulnerable group in criminal justice. Despite the ratification of the most important international treaties and conventions, the Republic of Moldova does not guarantee full respect for the rights of children in the penitentiary system. In this study we analyze the cause of I. E. v. Republic of Moldova application no. 45422/13 decision of 26 May 2020, final of 26.08.2020, generated by the physical and sexual abuse of the applicant in detention and the effective non investigation of these abuses, the examination of the current situation of the realization of the rights of children in detention, based on the reports of the UN Committee on the Rights of the Child and those elaborated by the Ombudsman Office and the proposing of recommendations to ensure more effective the rights of minors deprived of liberty.
