Summary/Abstract: The provisions of criminal law, among many assumptions, have a protective andguaranteeing function. One of the groups of entities covered by criminal law protec-tion includes minors. This protection can be analyzed both from the perspective ofa minor perpetrator of a prohibited act and from the perspective of a victim, whena minor is the subject of a crime. It is necessary to apply such criminal law protectionagainst sexual abuse of minor victims, which has lifelong negative consequences forthem, and their durability and intensity depend on the stage of development at thetime of being affected by the crime, the relationship with the perpetrator, the dura-tion of the abuse, the disclosure of the crime and the support received. Moreover, itshould be emphasized that there is an asymmetry in the ability to defend, which existswhen the perpetrator has a huge advantage that prevents the victim from having anydefense capabilities. Therefore, rightly, society and the justice system have a hostileattitude towards perpetrators with pedophilic tendencies. With this in mind, the articleaims to illustrate the Polish criminal law policy of protecting children against sexualexploitation, which nowadays even uses electronic techniques allowing the solicitationof children from a distance.
