Summary/Abstract: National minorities are part of the structure of the Romanian people. The study aims to analyze the current legal framework contributing to the preservation of the right to identity in general for national minorities. From this, we develop the specificity of the protection of this right in the public sector, focusing on the regulation relating to the exercise of this right in employment. The conclusion is that the current legal and constitutional legal system in Romania, provides for national minorities means to guarantee the right to express themselves, to evolve and grow, including in education and the right to work at European and international requirements.
