Regulation of public property under the new civil code

Summary/Abstract: The article reviews the way in which public property is regulated in Romania, under the new Civil Code. The provisions on this subject generate certain construance issues, contain inconsistencies which will clearly create difficulties in the process of their practical implementation. Additionally, we argue the fact that, also in terms of the terminology used, the current regulation contains some inconsistencies. There are employed concepts like public property, public domain, private domain, without clarifying their particular significance, relationship and correlation between the same.
