Some aspects of the applicability of legal provisions on compensation device. Conclusions resulting from the work of the Romanian Court of Accounts

Summary/Abstract: The current study aims to show some aspects regarding the approach of remuneration of the budgetary system staff. These issues tackle, on the one hand, the legislative incoherence’s reflected in the two laws regarding unitary remuneration, as well as some practices outside the legal framework, through which were given salary rights unforeseen by the law for some categories of staff from the public system. The study signals, as well, the deficitary reglementation of the appliance allowance that, according to ongoing legislation, is given only to the staff of the Internal Affairs Ministry and subordinated institutions, excluding some categories of staff that have similar activities, governed by the same principles, that do not beneficiate of this salary right. This is why, in order to eliminate this situation, the study proposes, in the end, the amendment of the legislation with a disposition that aims to include also the local policemen among the beneficiaries of this salary right.
