Summary/Abstract: Since the year 2003, when the economic freedom was established as a fundamental right in the Romanian Constitution, the Constitutional Court was seized multiple times regarding the analysis of the constitutionality of some legal provisions from the perspective of art. 45. Aproximately 15 court decisions were pronounced regarding some laws in the consumer protection field. All of them have been rejected, but their considerations allow configuring the content of economic freedom, as it is protected by the fundamental law.
