Summary/Abstract: The aim of this article is to describe legal position of Czech minority in the Republic of Poland. The Czech minority in Poland cannot be compared with the Polish diaspora in the Czech Republic. Both are minority communities with different positions and different scales of problems. Poles were on the territory of the Czech Republic as a result of political decisions contrary to the decision-makers and on the nationality of the population, since the Czech Republic was accompanied by areas inhabited mostly by Polish citizens. Considering the area of Cieszyn Silesia going to be assumed that the Poles are aboriginals. The Czechs, in turn, came to the Polish territory for fear of persecution by the Brethren activities. Czech minority in Poland, is a Czech immigrant, not native. The differences between the two minorities are also associated with its geographical distribution. Poles in the Czech Republic are concentrated in the Diaspora Zaolzie, while the Czechs in Poland, are dispersed within Poland. The main difference refers to numbers, Poles are a minority comprising 39,000 people in the Czech Republic‘ s second-most national community, Czechs in Poland is almost 100 times less 386 people according to the 2002 data which means – de facto – impossibility of carrying out any rights by the minority Czech.
