Summary/Abstract: The opinion deals with the problem of cognition of the Czech Constitutional Court to examine constitutionality of European Union secondary law, particularly in the context of a possible normative basis for that power. In none of the judgments is there any clear indication that the Constitutional Court has power to adjudicate on the constitutionality of EU secondary law. The author claims that this power may be indirectly derived from the Constitution. The author concludes that the Constitutional Court recognizes exclusive power of the Court of Justice to derogate EU legislation.
