Legal opinion on costs of financing lighting of motorways and expressways by the municipality.

Summary/Abstract: The opinion answers the question: “who, according to legislation in force, is obliged to finance costs of lighting of motorways and expressways which are not municipality own tasks?”. The Author claims that provisions regarding costs of financing lighting of motorways and expressways are not clear and rise some doubts in interpretation. The Author states that in accordance with the Polish law, municipality shall not incur in some situations the costs of lighting. That would contradict to the Public Finance Act and could constitute a breach of financial discipline.
