Legal opinion on judicial review of European Community/European Union secondary law, on the example of France.

Summary/Abstract: The opinion focuses on analyzing judicial review of secondary legislation of European Community/European Union in the judicial practice of the French Constitutional Council. The author stresses that review of constitutionality of secondary European Union law is the subject of constant discussion and controversy. The opinion presents the standpoint of admissibility of constitutional review of the EU law by the French Constitutional Council in the absence of equivalent protection (under EU law) of those values which determine French constitutional identity.
