Summary/Abstract: The benefit of the doubt has always raised many controversies and disputes in matters of human rights. It is one of the most important principles regarding the right of a fair trial. In this article, we will refer on some aspects of this concept, that was the subject of literature in numerous creations of famous authors in the law field. We have considered these creations when debating the institution itself and we have also taken into consideration the new regulations of criminal procedure.
