THE CONCEPT OF PROFESSIONAL QUALIFICATION IN THE CONTEXT OF REGULATIONS OF IMPROVEMENT OF PROFESSIONAL QUALIFICATIONS BY EMPLOYEES

Summary/Abstract: The aim of the article is to provide a definition of the concept of professional qualification, which has been found in the regulations of Labor Code. The definition of the concept of professional qualification is essential for carrying out the interpretation and application of the regulations on improvement of professional qualifications by employees. The main a thesis of the article is that the definition of professional qualifications in Labor Code is different from the one which is occurring in everyday language. The legislator link the concept of professional qualifications which the job or position and equated them with the term of qualifications. As a result, both the concept of qualifications and professional qualifications are the same in Labor Code.
