Summary/Abstract: Models of state system which until recently followed one another in Serbia were as a rule decisionistic. Priority has always been given to a particular political will/decision as opposed to a legal norm or the rule of law. Today, however, at least in civilized countries the norm has become determinative. The role of politics is no longer in making decisions but in producing the law. Insufficient because of the very nature of things, yet the best conceptual justification of decisionism was offered by the “classic” of political philosophy - Karl Schmidt. This remarkable author reveals key aporias which not only permeate but also contain the decisionistic model of the state organization. Until recently Serbia and its statehood have been consumed by the very aporias, which to some extent is happening even today under the regime that was created after the “revolution” of October 5, 2000. The aporias demonstrate how the decisionistic attitude towards the state is, on the one hand, extremely wrong but, on the other hand, realistic or at least symptomatically present. After all, they show that with strategic (but not tactical) moments of interpretation of contemporary political situation, decisionism must be replaced by a concept which is based on the rule of law. This text deals with key problems that Schmidt faced attempting to theoretically justify or establish decisionism.
