Summary/Abstract: Being the top of the arch in the private international law of contracts, the principle of autonomy of the will is expressed nowadays in art.3 of Rome I European Regulation regarding the law applicable to the contractual obligations. In this study it is examined from the perspective of its theoretical bases, of the enforcement conditions and of its material consequences, in the attempt to demonstrate to what extent the legal text is successful for its conciliation with the necessity of assuring the law authority.
