Summary/Abstract: The Bejan case was the third case in the field of preliminary rulings by a Romanian court. In the context, we can consider that this case is a good occasion not only to formulate criticism to the method of the reference, the lack of studying the general problem of preliminary rulings or of choosing the timing, but also to discuss the utility of the preliminary ruling from the perspective of the decision issued by the national court.
