Summary/Abstract: Precedent in the development of the institution of Ombudsman is the establishment of Ombudsman in Kosovo (2000-2005). International Ombudsman was appointed after the humanitarian intervention in Kosovo and Metohija, by the decision of the international community on the part of the territory of sovereign state. As a UN body and as a provisional institution with the main task to protect human rights and ensure the legality of administrative work in Kosovo, the international Ombudsman achieved its mission with partial success. The lack of institutions inherent in the position of Ombudsman, the non-respect of his recommendation by UMNIK and temporary institutions of self-government in the atmosphere of grave breaches of human rights are reasons for the inefficiency of the international Ombudsman. On the other hand the Ombudsman demonstrated a high level of authority, impartiality and transparency in his work as well as a professional analysis of problems regarding the human rights protection in Kosovo. The experience of international Ombudsman for human rights in Kosovo is the confirmation that the democratic capacities of a society determine the place and role of Ombudsman as well as the fact that Kosovo did not fulfil standards for resolving its final status.
