Summary/Abstract: This paper deals with international legal instruments that address the sexual violence against women in situation of armed conflict. Even though the rape was prohibited throughout centuries, it is only with the global pressure of advocates for women’s rights that it entered international courtrooms and became justicible along with such jus cogens norms as torture, genocide and enslavement. The paper addresses two issues in this respect. The first part deals with the feminist legal analysis and discussions in respect to the accomplishments/failures of the prosecution of individuals for committing the crimes of sexual violence in armed conflict, mainly focusing on discussions of definition of rape in international law. The second part of the paper poses the questions and presents some discussions in relation to the non-existing system to help redress survivors.
