Summary/Abstract: Art. 67 has stipulated that „the Eurpean Union is an area of freedom, security and justice with respect for fundamental rights and the different legal systems and traditions of the Member States. Afterwards, art. 81 explain more specifically, that this section empowers the legislature of the European Union - the European Parliament and the Council of the European Union - to adopt, „especially when it is necessary for the proper functioning of the internal market”, various measures to ensure „mutual recognition between Member States of judicial and extrajudicial decisions and their execution” states, as well as the „compatibility of the rules applicable in the Member States concerning conflict of laws and of jurisdiction” or „effective access to justice”.
