Referral to the High Court of Cassation and Justice in order to issue a prior decision to solve certain legal matters

Summary/Abstract: The emergence of the New Civil Code has determined the introduction of new institutions in the Romanian law system. Among these there is the title called: "Provisions regarding the ensurance of a unitary jurisprudence". The declared purpose of this procedure is the creation of a new mechanism to unify the jurisprudence in order to contribute, along with the appeal on matters of law, to the tranformation of the Romanian jurisprudence into a predictable one, which can meet the reasonable expectations of the justice seekers, and also to lead to shortening the trials by preventing the completion of all appeals.
