Summary/Abstract: The article examines legal issues specific to the infringement action, which requires clarifications. The issues related to the legal nature of the civil infringement action are put into question again and questions requiring the intervention of the legislator in the matter of the interim measures for the protection of intellectual property rights. The measures, proceedings and sanctions applied for the settlement on the merits of the civil infringement action, are described in detail.
