Theoretical and practical aspects of applying article 5 of Law no. 143/2000

Summary/Abstract: The origin of this incrimination lies in the law for drug abuse control of April 25, 1928 and the latter originates in the International Convention for drug deal control from February 19, 1925 of Geneva, to which Romania adhered on December 30, 1931. The crime against which the Romanian lawgiver reacted by means of this incrimination is the danger for public health represented by the provision of a bar, dwelling or any other place where drug users might meet to consume drugs collectively. The offense of organizing or tolerating illegal drug consumption is regulated by article 5 of Law 143/ 2000 and consists in deliberately providing a bar, a dwelling or any other place with public access, for illegal drug consumption or which tolerates illegal consumption.
