Summary/Abstract: In order to fulfil the obligations undertaken in the Stabilisation and Association Agreement regarding harmonization with the so-called consumer directives of the European Union, and in order to implement more effective consumer protection, the Republic of Serbia passed a new Law on Consumer Protection in 2010. This law grants Serbian consumers the same rights granted to the consumers in EU countries many years ago. This paper considers three basic consumer rights in the Serbian law and the law of the EU: the right to unilateral termination of contract, the right to protection from unfair contractual provisions, and the right to protection from unfair commercial practices. In addition to the analysing the terms, conditions, and procedures of exercising the consumer right to unilateral termination of contract, as well as the legal consequences of a unilateral termination of contract, the paper particularly deals with the problems of exercising this right. In considering the consumer right to protection from unfair contractual provisions and the consumer right to protection from unfair operation, in addition to highlighting the relevant provisions of the Law on Consumer Protection, this paper also analyses the provisions of the corresponding EU directives which were used as a model by the Serbian legislators, with special focus on the differences in comparison with these directives.
