Video Surveillance In Public Spaces And The Right To Privacy

Summary/Abstract: In modern times video cameras have been extensively used for surveillance of public areas, for security purposes, and to maintain public order. However, even though closed-circuit TV is ought to be used in the interest of citizens, video cameras also collect information about individuals, their movements, and their activities, which can be used to undermine their right to privacy. In addition, unauthorized and excessive manipulation of personal data could affect the freedom of assembly and association and the freedom of opinion and expression, which should not be tolerated in a democratic society founded upon the rule of law. Therefore, this paper discusses the application of video surveillance and its interference with privacy and civil liberties, with special focus on comparative and European regulation, and the almost non-existent legal framework pertaining to this issue inthe Republic of Serbia. The final part of the paper offers several recommendations that could improve this complex issue.
