STALKING AND THE MECHANISMS OF REACTION

Summary/Abstract: The paper examines the phenomenon of stalking, which has been the subject of considerable attention of the professional and general public starting from the end of the last century and onwards. Although it may seem that stalking is relatively benign problem compared with other harmful occurrences and other forms of violence, this notion is wrong. Actually, it is not uncommon for stalking to involve inflicting injuries and other dangerous consequences. Above all, stalking implies overstepping of the boundaries of intimacy and privacy, which could have a serious negative impact on the quality of life of stalking victims. The author also analyzes some widely known definitions of stalking and summarizes the findings of couple of stalking studies. Afterwards, author examines the mechanisms of criminal law reaction, as well as the problem of effective protection against stalking while at the same time avoiding the problem of over-criminalisation and the problem of imposing excessive restrictions on freedom. Finally, the author analyzes Serbian criminal law, by accentuating that it currently does not incriminate stalking.
