Considerations on the Need of Legal Regulation of Aggressiveness in the Social Sphere

Summary/Abstract: The study aims at identifying the differences between subjects in terms of their level of aggression, being useful in drafting an investigative - legislative framework adapted to the needs or to the social reality. An intensely disputed domain in terms of aggressiveness is aimed at domestic violence, the population of Romania being the most tolerant to family violence in all its forms, compared with the average of the European Union. In the social life there is an increase of aggressiveness. This problem of aggressiveness - either collective or individual redressed actions - the highest standard of modernity. At the global level there are social-psychobiologic studies that estimated that this century is saturated of frustrations and aggressions. Law No. 25 from the 09th of March 2012, amending and completing the Law no. 217/2003 with regard to the prevention and fighting family violence, published in the Official Journal no. 165 from the 13th of March 2001, promulgated by Decree No. 273/2012 shall come into force on May 2012, so that any victim of family aggressions will be able to approach new instruments for fighting against domestic violence and aggressors, such as restraining orders and protection orders. According to the hypothesis that stipulates that the means of prevention fail and the abused victims are already in domestic violence chains, they invent means to fight violence, which they bring by way of absolute novelty in the family violence act. The jurisprudence is to be written starting from May 2012 to demonstrate effective specific restraining order and protection orders, and all measures in order to fight the increase of the unfortunate effects of a growing phenomenon. The study of the social actors identified aggressiveness which has underlined deficiencies at the legislative level that can be corrected through the improvement existing legal mechanisms or through the creation of other means adapted to Romanian cultural space.
