Summary/Abstract: Under the recent novelisation of Polish Code of Administrative Procedure it is possible to bring the public administration agency to the court in case of protraction of the administrative proceeding. This shall be noted as a substantial change in administrative law as so far the agency was responsible for the damages caused due to the inactivity. This paper brings closer the issue of the legal responsibility for the damage caused by public administration agency in case of the protraction or inactivity under administrative and civil law. The subject of some concern was also the adequacy of using the notions of “protraction” and “inactivity” in administrative and civil law.
