Critical examination of the correlation between the new civil code and the labor code

Summary/Abstract: On 25 June 2009, the Parliament of România passed the new Civil Code of Romania (published on 24 July 2009 in Monitorul oficial al României (Official Gazette of România). Starting from the stipulation in Art. 295 (1) of the Romanian Labour Code (effective from 1 March 2003) that the Labour Code provisions shall be complemented with the Civil Code provisions, the authors make a critical examination of the latter’s provisions that are incompatible with the specifics of labour relationships, such as: – provisions in the Labour Code, viewed from the perspective of their complementariness, in part or in whole, with the new provisions of the Civil Code; – provisions in the new Civil Code that are incompatible with, and therefore inapplicable to legal labour relationships.
