Specific considerations regarding the aptitude for work of the employee

Summary/Abstract: The present study intends to analyze the ability for work of the employee from a medical point of view, following the conclusion of the individual labor contract, from the perspective of the right of the employer to decide whether to fire the employee or not when, by a decision of the competent medical expertize institutions, the employee is found unable physically or/and mentally to fulfill the duties corresponding to the position held, according to art. 61 letter c) of the Labor Code.
