CONSIDERAŢII PRIVIND STABILIREA TEMPORARĂ A SEDIULUI UNEI SOCIETĂŢI LA SEDIUL PROFESIONAL AL AVOCATULUI
CONSIDERATIONS CONCERNING THE TEMPORARY ESTABLISHMENT OF A COMPANY'S HEADQUARTERS AT THE ATTORNEY'S OFFICE

Summary/Abstract: Regarding the current regulation of the activity of establishing the headquarters of a company at the attorney's office, according to art. 3 lit. H) of Law no. 51/1995, and the special conditions under which a legal assistance contract may be amended, according to the Statute of the Lawyer's profession, the only legal way expressed by the legislator is the right of the parties to conclude a new and separate legal assistance contract (or more) in compliance with the one-year term stipulated by art. 105 para. (2) of the Statute of the Lawyer's profession. The additional act of extension of the legal assistance contract initially concluded does not constitute a legal means allowing the modification of the legal assistance contract, according to art. 104 of the Statute of the Lawyer's profession.
