Summary/Abstract: This text deals with long and sofar unsuccessful process of Western Sahara decolonization. Spain definitely left its 53rd province of Western Sahara in 1976. Afterwards Sahara has heen annexed by Morocco and Mauritania, which soon withdrew from the territory and stood on the side of the Saharawi people in the conflict. The war between Morocco and Front Polisario broke out and continued until 1991. The realization ol refrendum on the future status of Western Sahara was promised to Saharawis already in 1975. Since then the long-standing process of plebiscite freezing and delaying is going on. Morocco still denies renouncement of its territorial claims and occupation. It declines any possibility of existence of independent Sahara. Moroccan Kingdom with a support, for the most part of France, and also due to the ineffectiveness of international community, has been for thirty years successful in maintaining of status quo in Western Sahara. Saharawi-moroccan conflict introduces the basic questions of international law in the face of realpolitik carried out by the players in this dispute. The Peace Plan that ended the longtime bloodshed on the both sides was signed already in the beginning of the 1990s. However, the United Nations still have not found sufficient instruments to enforce the realization of free plebiscite. Organization and realization of a free and fair referendum still remains a task for the future.
