Summary/Abstract: A condition for exercising the right of appeal is the quality of the injured party, supposing the existence of a legitimate interest and a injury produced or an injury that is most probably to occur. An appeal filed by a bidder located on a lower position against the outcome of the procedure is, in principle, lacking interest, situations which concern general issues that may lead to a change in the ranking are not to be exluded, being necessary to examine the legitimate interest on a case by case basis.
