Summary/Abstract: As a general rule, the civil trial passes through two major phases: judgment and enforcement. Traditionally, these stages have been structured in: written stage; stage of pleading in open debates and the judging and verdict stage. In drafting the new regulation, the authors of the new Code of Civil Procedure considered the current staging of the civil trial conducted primarily by theorists. However, they went further on, by setting very clear procedural moments delineating these stages, they detailed these stages and certain legal institutions and procedural rules enshrined in the civil trial have been waived.
