Law no. 287/2011 – one major step towards the plenitude of competence of the legal executors

Summary/Abstract: The initiative of the legislative body to eliminate the professional structure of the bank executors who worked as employees and subordinates of the creditor is welcome. However, we believe that the solution found through the adoption of Law no. 287/2011 is open to criticism at least under the aspects showed in the present document. The identified compromise solution is clearly in favour of the bank executors, acknowledging the experience acquired in the respective profession, however it violates the equality of treatment and opportunities in relation to the people who acquired this quality following some specialty examinations, as well as to the interests of the persons who wish to access this profession, by overloading the structure compared to the number of inhabitants.
