Changes in banking and insurance law in the range of financial intermediation during the period of political transformation. Part 1 − banking law

Summary/Abstract: The aim of this article is to present its readers with legal regulations concerning the issue of entrusting by banks third parties with the performance of bank operations. The first part of the article describes the changes in the area of bank outsourcing, particularly the changes in the subjective scope of entrusting third parties with bank operations by banks over the last few years. Characteristic proved to be, in principle, liberalization and diminishing bureaucracy of bank outsourcing. Liberalization, however, should be considered as insufficient, but the newly created rules should not be detrimental to the compliance of the bank’s activity with the provisions of law, the sound and prudent management of the bank, the protection of legally protected secrecy, or performing effective supervision from the Polish Financial Supervision Authority.
