The evolution of ownership during the economic transformation of the turn of XXTH and XXIST century

Summary/Abstract: The article includes considerations for changes in the way and extent of recognition of ownership. It starts from the historical recognition in legal regulations in an earlier period of the Partitions of Poland, and continues throughout the period after the regaining of independence by Poland, the specific regulation of ownership rights in the Constitution of 1952, systemic changes until after the turn of the 1990s, and current understanding of property rights transfer in the Polish constitution from 1997. The analysis showed the presence of the close relationship between the objectives of shape, scope and importance of the right of ownership. Despite the reported differences in constitutional terms and the Civil Code property and ownership is a guarantee of the proper functioning of the market economy and provides certainty to economic participants.
