Shaping the European law concerning the carriage of passengers

Summary/Abstract: The paper discusses the process of shaping the EU system of passengers protection. The solutions adopted by the EU have developed in two directions. The first direction is the improvement of the level of passengers protection in situations which have been already regulated by the international law (e.g. the responsibility for the life and health of passengers, the responsibility for luggage, the delay in carriage). The second direction is the establishment of new rules for the protection of passengers in circumstances that have not been regulated by the conventions (e.g. the rights of passengers with disabilities or reduced mobility, the responsibility for denied boarding, the cancellation of journey or delayed departure, special rights of passengers in such situations, obligations to inform passengers of their rights, the complaints procedure).These regulations have also introduced the requirement for carriers to insure their activity or to have other financial security. The paper presents the specific elements of the system and compares the regulations. The author brings into question the diversity of some solutions in similar situations in various branches of transport.
