The administrative and legal model of calculating damages and relief for medical events

Summary/Abstract: The Act on the patients' rights and the Patients Laws Advocate introduces a new model of assessing compensations and remedies in medical cases, which is supposed to present a simplified way of claiming compensations (remedies) by the patients. The authors begin a characteristic of this administrative and legal model, as well as of proceedings in the legal status analysis, and the scope of work of regional commissions dealing with medical accidents adjudication. The subject of this study in also the range of the proposal, which is the reason for taking proceedings, with a special focus on per- sons eligible for submitting it. At the same time an issue of the proceeding progress had been introduced, including the legal characteristics of the commissions' adjudications. The authors also underline the crucial matters considering the proper usage of the civil proceeding codex regulations in a discussed proceeding.
