Summary/Abstract: The subject of this study is issues related to employee rights during states requiring extraordinary measures, such as martial law, a state of emergency or a state of natural disaster. The legislature permits a situation in which some fundamental employee rights are limited, such as the right to strike, freedom to work, the right to safe and hygienic conditions of work, and the right to rest. The Author estimates if and to what extent regulations that limit some employee rights fulfill functional needs from the perspective of the State’s needs and limits on human and citizen rights.
