The Cultural Rights in European Context

Summary/Abstract: The author holds the argument that no matter how elusive is the concept of cultural rights, its appearance is historically non-coincidental and its development is an indicator of growing humanization of societies. However, the present preoccupation with the issues of culture and cultural rights is far from receiving a satisfactory explanation from theoretical point of view, neither its legality is applied properly in social practices. Supporting the idea of universal interpretation of cultural rights rather than reducing the problem to ethnic, religious or some other minorities, the author stands the view that the new realities of enlarging European Union need first of all reconceptualization of the idea of majority – minority, and therefore – of cultural rights as universal rights enjoyed by members of the Union on individual rather than on group level.
