The role of realistic philosophy in forming human legal culture

Summary/Abstract: The question, implicitly hidden in the title of the article, de facto raises a problem of philosophy’s role in human culture, and even culture’s purpose in human life. Undoubtedly, the answer presupposes an understanding of man, culture, and philosophy. The article finds its motive in facts of corrupted positive law, that sometimes not only seems to strike at fundamental human goods (life, health, personal development), but also becomes an instrument and program of constructing social life in totalitarian or criminal way (e.g. national socialism in Germany, or bolshevism in Russia). The author strives for answering to the following question: does the human law, as being a rule and measure of social activity legislated by the authority, in any sense need a philosophy, and if it does, then in what aspect, and what philosophy? The author claims that the relation between law and philosophy is indispensable, and its negation results in an anti-human consequence – a barbarian reality. Nowadays, man needs realistic philosophy that enables him to cultivate human culture, especially human legal culture, where law is regarded as a means and assistance in human development.
