Summary/Abstract: The mainstay of the paper is formed by an analysis of human rights as the subjects of binding international legal obligations, the realization of human rights, and the scope of criminal law. The results of the current study converge with prior research on international comparative analysis among penal systems, the penal power of the state in American legal discourse, and U.S. penal practice.
