The Rule of Accusatorial Procedure in Polish Criminal Proceedings

Summary/Abstract: The issues connected with the rule of accusatorial procedure in Polish criminal proceedings were discussed against the backdrop of general theoretical topics and chosen issues of criminal proceeding’s theories. The authoress of the article shows the chosen topics of law’s theories related to the problem of law system’s rules, law’s rules and points out the influence of R. Dworkin’s and R. Alexy’s theories on the taxonomy of criminal proceeding’s rules. Later, she points out the device of compassing the legal norm as a criminal proceeding’s rule, its importance in criminal proceeding and character in law’s system. The problem of accusatorial procedure’s rule was discussed in a narrow meaning and contains the general questions connected with the concept of this rule in a system of criminal proceeding’s rules, correlation with another legal rules and functions executed by this rule.
